Omission from White Pages
Where a provider is found to be at fault for a directory omission, the
TIO will consider compensation claims for business loss.
However, these sorts of complaints are often very difficult to resolve because
the results of a directory omission may not be apparent until many months
after the complainant became aware of the omission. Moreover, losses may
be very difficult, if not impossible, to substantiate. New businesses, for
example, may only ever be able to speculate on potential losses.
The TIO can only examine claims for loss that can be substantiated. Businesses
which have been established for a number of years may be able to provide
proof that their income has decreased for the year the listing was not correct.
In considering claims for business loss as a result of directory omissions,
the TIO expects businesses to provide the types of figures and financial
documents outlined in the section Compensation
for business loss.
